1. DESCRIPTION OF DOG

2. CONSIDERATION
$_________ paid on this date upon receipt of the Beagle and
signing of this contract.
3. CONDITIONS
The Purchaser agrees to take this Beagle to a licensed
veterinarian within 72 hours of purchase for a health check and to bring any
concerns to the Breeder’s attention.
The Purchaser will continue with the schedule of vaccinations
as recommended by their veterinarian.
The Purchaser affirms that they are not acting as an agent in
the purchase of this Beagle.
The Purchaser agrees to take good and proper care of this
Beagle and agrees that the Beagle will reside at the home of the Purchaser.
The Purchaser agrees that this Beagle is not to be left in a
backyard or kennel only.
This Beagle is sold with the understanding that the Purchaser
avowed that the Beagle would become part of their family.
The Beagle will be given adequate shade, shelter and housing,
have access to a fenced yard, and will be properly and sufficiently fed, while
not being allowed to become obese. He will receive proper veterinary care
throughout his lifetime, including annual (or as recommended) vaccinations and
preventative health care.
The Beagle shall not be mistreated or abused, be allowed to
run loose, nor shall he be kept chained or tied, or allowed to ride in the back
of an open pick-up truck (pursuant to the Motor Vehicle Act of BC), whether
crated or not .
The Purchaser will spay/neuter the Beagle before the Beagle
reaches the age of 9 months and will provide certification of this to the
Breeder. Once the certificate of spay/neuter has been provided, the AKC papers
will be delivered to the Purchaser.
Purchaser guarantees the Breeder the right of first refusal
if the Beagle is to be sold or disposed of in any way. If Breeder does not wish
to acquire the Beagle, Breeder will assist the Purchaser in placing the Beagle.
If Breeder does take this Beagle back for placement in another home, signed
registration papers must accompany the Beagle, and a suitable refund will be
made upon placement of said Beagle, after Breeder has deducted costs of keeping
and placing the Beagle.
Under the terms of this contract, the Breeder has the right
to investigate the care of this Beagle if circumstances warrant. If the Breeder
feels this Beagle is not getting proper care and treatment, the Breeder has the
right to have the Beagle examined by a licensed veterinarian mutually agreeable
to the Purchaser and Breeder. If the veterinarian finds the Beagle a victim of
ill-treatment, abuse or neglect, the Breeder has the right to take full
possession of the Beagle, without compensation. Under such circumstances, all
warranties are then VOID.
4. WARRANTY
Our first concern is for the well-being of our puppies
throughout their lifetimes. Therefore, if - for any reason and at any time - you
choose not to keep your Beagle, return the dog to us and we will refund the
purchase price. A suitable deduction will be made to the refunded amount based
upon the dog’s age, and if he/she has any preventable conditions, including but
not limited to: obesity, scarring, signs of abuse, parasites, and a lack of
basic training.
We have done everything possible to ensure that the Beagles
we breed do not carry life-threatening genetic defects. We have nevertheless
decided on the following policy, should the unthinkable occur:
If the Beagle’s owner (upon advice of a reputable
veterinarian) determines that the Beagle’s quality of life is seriously affected
because of a genetic defect within the first three years of the Beagle’s life,
we provide the following options:
This warranty expressly covers ONLY the refund or partial
refund as listed, and does NOT cover costs of health care, treatments, or
surgeries which Purchaser may elect to have done. If any problems do arise the
Purchaser must notify the Breeder immediately, prior to undertaking any
treatment, unless an emergency situation.
Manahound Beagles has represented this Beagle as companion
quality, which means the Beagle has minimal faults in structure, movement, or
breed type, and/or has minor cosmetic faults at the time of sale. The Beagle has
been evaluated for temperament and raised in an environment to ensure a
temperament suitable for this breed. The Breeder therefore expects the Purchaser
to properly raise and train this Beagle, ensuring good socialization is
completed.
5. FURTHER CONDITIONS
Breeder and Purchaser agree to stay in contact with each
other and keep each other apprised of any change of circumstances, address, or
telephone number.
Manahound agrees to be accessible to Purchaser and to help
solve any problems and answer any questions the Purchaser may have in the
raising and training of this Beagle.
Violations of the terms of this contract render all
guarantees stipulated in this contract to be null and void and may result in the
Purchaser being required to return the Beagle to Manahound within five days of
receipt of notice. The Purchaser will be responsible for the cost of the puppy's
transport back to Manahound. If the Purchaser violates this agreement, they will
be responsible for any and all legal costs Manahound incurs enforcing this
contract.
PURCHASER HAS READ AND UNDERSTANDS THE FOREGOING AND AGREES
THAT ALL PARTS AND PORTIONS THEREOF CONSTITUTE A BINDING AGREEMENT.
THIS CONTRACT CONSTITUTES THE ENTIRE AGREEMENT OF BOTH
PARTIES WITH RESPECT TO THE SALE MENTIONED ABOVE. NO PART OF THIS CONTRACTUAL
AGREEMENT IS TRANSFERABLE.
FURTHER, SIGNATURE BELOW ACKNOWLEDGES RECEIPT OF A COPY OF
THIS CONTRACT BY THE PURCHASER.
